Channell History LLC - Terms of Service and Return Policy

1. Introduction

These Terms of Service and Return Policy (hereinafter referred to as "Terms") govern the contractual relationship between Channell History LLC (hereinafter referred to as "Company" or "we") and any individual or entity (hereinafter referred to as "Customer" or "you") engaging our services. By utilizing our services, you are bound by these Terms, which constitute a legally binding agreement. It is imperative to review these Terms carefully prior to proceeding with any order.

2. Services Provided

Channell History LLC specializes in the digital conversion of vintage media formats, transcription of documents, and genealogical research. The Company endeavors to digitize and enhance analog media to a quality equal to or surpassing the original format. However, the Company disclaims liability for any low-quality or damaged media that cannot be enhanced to a higher quality standard.

3. Returns, Refunds, and Exchanges

The Company does not entertain any requests for returns, refunds, or exchanges. All transactions are considered final. In the event of any issues arising from the quality of digitized products due to errors attributable to Channell History LLC, the Company will, at its discretion, re-digitize the media without additional charge to the Customer.

4. Content Restrictions

Channell History LLC does not process or accept media content of an adult or violent nature. The Company reserves the right to return such media to the Customer, accompanied by a fee of $50.00. Any discovery of child pornography or illegal activities will result in immediate reporting to law enforcement agencies.

5. Right to Refuse Service

Channell History LLC retains an absolute right to refuse service to any Customer for any reason.

6. Payment Terms

• Upon the request for payment, whether through phone communication, email correspondence, or text messaging, the Customer shall remit payment within a grace period of 7 days.
• Subsequent to the initial 7-day grace period, the Company shall levy a fee of $25.00 every 7 days until payment is received.
• The Company shall not dispatch the Customer's vintage media until full payment has been successfully processed.

7. Returned Payments and Bounced Checks

In the event of returned payments or bounced checks, the Company shall assess a fee of $50.00.

8. Legal Action

In circumstances necessitating legal action initiated by Channell History LLC against a Customer, the Customer is liable for any and all legal expenses incurred by Channell History LLC in the pursuit of such legal action.

9. Agreement

By initiating an order, entering into an agreement either verbally or in written form, the Customer unequivocally assents to be bound by these Terms.

10. Additional Provisions

• The Company reserves the prerogative to modify these Terms at its discretion. Any such modifications shall become effective upon publication.
• Channell History LLC disclaims responsibility for any loss or damage to the Customer's media during the digitization process. Customers are strongly encouraged to create backup copies of their media.
• The Company retains the right to employ digitized materials for promotional purposes unless explicitly agreed otherwise in written form.

11. Privacy and Data Security

Channell History LLC acknowledges its commitment to preserving the privacy and security of Customer data. The Company maintains stringent confidentiality standards pertaining to all Customer information and media submitted for digitization or research. However, while diligent efforts are exercised to protect data, the Company cannot guarantee complete security during electronic data transmission or storage. 13. Governing Law

These Terms shall be construed and governed by the laws of Navajo County, Arizona, United States, excluding any conflict of law principles.
